March 2010 The Lawsuit UPDATE
Thank you to everyone who has given us words of encouragement, written letters to the papers, and donated to our legal fund, it feels really good to get this validation for what we do. We do have a have a law firm working for us Pro Bono, thanks to Dave Alden (current Art Center Director), who found us legal support through his contacts. But Pro Bono does not mean totally free and we have accumulated some debt for the lawsuit already. We need donations to cover our costs that are projected to be around $5,000- see PayPal button below.
We hear from many people that they thought the lawsuit was over; that they figured the suit against us would be thrown out because it is frivolous. It is a nice thought, but this kind of lawsuit cannot be thrown out of court, the charges against Bud Farley and MCTV have to be disproved in a trial, unless the (former) Footlighters drop the suit. It may take another 15 months to get to the trial.
On January 23, 2010, A Case Conference was supposed to happen.
A Case Conference is the first time the lawyers meet with the judge for the case. A few things are supposed to happen in this first meeting with the judge - a date for the trial and the kind of trial (jury or judge) gets established. But on the 23rd there was a substitute judge and the lawyers could not agree on a number of issues and so the Case Conference was continued until April 2010.
